By accessing or using the Site you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Site.
Your use of the Site and our collection of personal information is also governed by our Privacy Policy.
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Filmpitch LLC.

The Site is provided on an “as is” and “as available” basis. Business Pitch disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Business Pitch makes no guarantees regarding uptime, availability, or uninterrupted access to the Services.
Content generated through the Site is produced by artificial intelligence systems.
You acknowledge and agree that:
You are solely responsible for how you use AI generated outputs and for ensuring your use complies with applicable laws and regulations.
To the extent permitted by applicable law, Business Pitch assigns to you any rights it may have in the AI generated output created through the Services once it has been generated and delivered to you.
You may use generated content for personal or commercial purposes.
However, Business Pitch does not guarantee that:
Business Pitch retains all rights, title, and interest in the Site, software, artificial intelligence systems, algorithms, and underlying technology used to provide the Services.
You may submit prompts, documents, images, spreadsheets, logos, or other materials to the Site (“User Content”).
You represent that:
Business Pitch may collect and analyze prompts, usage patterns, metadata, and interaction data to improve, develop, and train artificial intelligence systems used by the Services. Such use may include aggregated or anonymized data and will not intentionally disclose identifiable user content publicly without permission.
You may not use the Site to:
Business Pitch may review, remove, restrict, or disable access to content that violates these Terms or applicable laws. Business Pitch is not obligated to monitor all content but reserves the right to do so.
Memberships are billed on a monthly or annual basis and do not automatically renew. Each subscription term (monthly or annual) grants you a fixed number of Pitch Creations and Sends for use during that term only.
Any unused Pitch Creations, Sends, or credits expire at the end of the applicable billing term and do not carry over, regardless of whether they were used during that period. Unused credits are non-refundable unless required by applicable law.
At the end of each term, your subscription will end automatically. You are free to manually purchase the same or a different subscription plan again at any time. Business Pitch does not automatically charge, renew, or re-enroll you in any membership plan without your affirmative action to purchase a new term.
All payments are processed through third party payment providers such as Stripe or PayPal.
By making a purchase you agree to the applicable terms of the payment provider. Business Pitch does not store credit card information.
Due to the digital nature of AI generated content, purchases are generally non-refundable. This includes any unused Pitch Creations or Sends remaining at the end of a billing term, which expire as described in Section 10 and are not eligible for refund, credit, or extension.
Refunds may be granted at our discretion where required by applicable law.
The Site may integrate with or link to third party services. We are not responsible for the availability or actions of third party services.
If Business Pitch provides developer APIs or integrations in the future, such access may be subject to additional terms, usage limits, and developer policies.
To the maximum extent permitted by law, Filmpitch LLC will not be liable for indirect or consequential damages, loss of profits, loss of data, or claims arising from AI generated content.
Our total liability under these Terms will not exceed the amount paid by you to Business Pitch in the previous 12 months.
You agree to indemnify and hold harmless Filmpitch LLC from any claims arising from your use of the Site, your User Content, your violation of these Terms, or your use of AI generated outputs.
Business Pitch respects the intellectual property rights of others.

We may suspend or terminate your access to the Site at any time and for any reason, including violations of these Terms.

These Terms are governed by the laws of the State of Delaware, United States.
Disputes will first attempt to be resolved through informal negotiations.
If unresolved, disputes will be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules in Delaware, United States.
You agree that disputes will be resolved on an individual basis and not as part of a class action, consolidated action, or representative proceeding.
Business Pitch will not be liable for delays or failures caused by events beyond our reasonable control including natural disasters, internet outages, cloud provider failures, government actions, or unforeseen events.

These Terms constitute the entire agreement between you and Filmpitch LLC regarding the use of the Site and supersede any prior agreements or understandings relating to the Services.
